Compliance to the normative system is the only way to maintain the Rule of Law, which according to the author becomes possible when citizens feel not only a legal, but also a political and moral obligation to obey the norms. El mundo globalizado ha producido un nuevo derecho, que aún no ha sido explicado ni mucho menos justificado por una teoría jurídica de la globalización. Las teorías jurídicas contemporáneas se han construido desde el Estado-nación, y muy pocas han abordado los problemas que plantea ese derecho que hoy es dominante. En este artículo explicamos las variables jurídicas del neoliberalismo, y damos cuenta de algunas teorías que pretenden explicar y justificar el derecho de la globalización neoliberal. The organism-in-its-environment is recognized as the basic unit of analysis when dealing with living beings. This paper seeks to define the fundamental implications of the concept of the organism-in-its-environment in terms of the biosemiotic concept of human distributed cognition. Human distributed cognition in a biosemiotic context is defined as the ability of a self-referencing organism-in-its-environment to interact with its environment to satisfy its physiological and social needs to survive and sustain itself. The ontogenetic development of the organism-in-its-environment serves as the (...) backdrop to discover the implications of distributed cognition that have general applicability in organisms, but in this paper, are made relevant to human beings. All information results from a process, intrinsic to living beings, of info-autopoiesis or information self-production; a sensory commensurable, self-referential feedback process immanent to Bateson’s ‘difference which makes a difference’. To highlight and illustrate the fundamental nature of the info-autopoietic process, initially, two simulations based on one-parameter feedback are presented. The first, simulates a homeostatic control mechanism (thermostat) which is representative of a mechanistic, cybernetic system with very predictable dynamics, fully dependent on an external referent. The second, simulates a homeorhetic process, (...) inherent to biological systems, illustrating a self-referenced, autonomous system. Further, the active incorporation/interference of viral particles by prokaryotic cells and the activation of CRISPR-Cas can be understood as info-autopoiesis at the most fundamental cellular level, as well as constituting a planetary network of self-referenced information. Moreover, other examples of the info-autopoietic nature of information are presented to show the generality of its applicability. In short, info-autopoiesis is a recursive process that is sufficiently generic to be the only basis for information in nature: from the single cell, to multi-cellular organisms, to consideration of all types of natural and non-natural phenomena, including tools and artificial constructions. The concept of information has been extensively studied and written about, yet no consensus on a unified definition of information has to date been reached. This paper seeks to establish the basis for a unified definition of information. We claim a biosemiotics perspective, based on Gregory Bateson’s definition of information, provides a footing on which to build because the frame this provides has applicability to both the sciences and humanities. A key issue in reaching a unified definition of information is (...) the fundamental problem of identifying how a human organism, in a self-referential process, develops from a state in which its knowledge of the human-organism-in-its-environment is almost non-existent to a state in which the human organism not only recognizes the existence of the environment but also sees itself as part of the human-organism-in-its-environment system. This allows a human organism not only to self-referentially engage with the environment and navigate through it, but also to transform it in its own image and likeness. In other words, the Fundamental Problem of the Science of Information concerns the phylogenetic development process, as well as the ontogenetic development process of Homo sapiens sapiens from a single cell to our current multicellular selves, all in a changing long-term and short-term environment, respectively. Gregory Bateson is well known for defining information by stating “In fact what we mean by information – the elementary unit of information – is a difference which makes a difference…” This conceptual perspective has the merit of simplicity and generality. Simplicity, in addressing the complexity of information. Generality, in seeking applicability to any and every field of human experience. The purpose of this paper is to focus the applicability of this conceptual approach by Bateson and use it to perform (...) a calculation of taking the difference between two grey-level digital images that are shifted one relative to the other. The digital images take the place of the field of view that a human being would have access through her sense of vision at two different spatial/temporal instances. The results show that it is possible to highlight the edges of the objects under scrutiny, as well as to highlight other differences within the object. Bateson’s “difference that makes a difference” would seem to provide a first step in the elusive meaning making process of humans. (shrink)

This paper presents a human-robot closely collaborative solution to cooperatively perform surface treatment tasks such as polishing, grinding, finishing, deburring, etc. The proposed scheme is based on task priority and non-conventional sliding mode control. Furthermore, the proposal includes two force sensors attached to the manipulator end-effector and tool: one sensor is used to properly accomplish the surface treatment task, while the second one is used by the operator to guide the robot tool. The applicability and feasibility of the proposed collaborative (...) solution for robotic surface treatment are substantiated by experimental results using a redundant 7R manipulator: the Sawyer collaborative robot. Distributed cognition is widely recognized as an approach to the study of all cognition. It identifies the distribution of cognitive processes between persons and technology, among people, and across time in the development of the social and material contexts for thinking. This paper suggests an ectoderm-centric perspective as the basis for distributed cognition, and in so doing redefines distributed cognition as the ability of an organism to interact with its environment for the purpose of satisfying its most basic physiological (internal (...) and external) and social needs in order to survive and sustain itself. Underlying this ectoderm-centric perspective is a proposed theory of reactive and interactive learning. (shrink)

La segunda parte provee una amplia perspectiva sobre “todo lo que el mundo hispánico ha dicho sobre Peirce” entre los años 1883 y 2000. El trabajo de revisión de la bibliografía consiste en un catálogo razonado de la producción hispánica sobre Peirce y un estudio crítico previo donde se delinean los aportes fundamentales, las carencias y las líneas de tensión de esa producción. -/- . El leitmotiv que impulsa a Jaime Balmes en todo su quehacer es un profundo amor a la verdad. Con él se da comienzo al estudio de su Antropología, pues es gracias a esa confianza y apuesta por la verdad-realidad por la que se justifica y alienta la búsqueda concreta de la verdad del ser humano. Partiendo de ella, revitalizada la verdad y nuestra capacidad cognoscitiva, Balmes afronta el problema antropológico contemporáneo, a saber, si existe la naturaleza humana y qué (...) sea ésta. Rescata así, prontamente, la esencia y la existencia humanas, esto es, la verdad y la libertad del hombre, existencia libre que sólo puede llegar a su perfección si asume y desarrolla su propia esencia o verdad –«La verdad os hará libres»–. Recuperada la naturaleza humana, su esencia, Balmes se puede preguntar por qué sea ésta, por qué es el ser humano. Siguiendo su realismo metodológico (objetivo y subjetivo), se aborda esta importante cuestión desde un primer estudio analítico (lo que le liberaba de cualquier forma de panteísmo), completándolo con el sintético posterior (librándole entonces del exceso relativista). Pero esta división metodológica se va a mostrar, en la antropología balmesiana, como clave misma de interpretación del ser y misterio humano: Antropología integral e integradora que permite comprender y acoger al ser humano en toda su riqueza y diversidad, y le ofrece el camino de la armonía o unidad, en esa diversidad (interior y exterior), como clave para alcanzar su máxima plenitud. While concerned with how man achieves his status as a moral being, Friedrich Schiller develops a concept of play that serves as a bridge between our sensuous existence to the rational, realizing moral freedom. In what ways might we extend this concept to the non-human animal? Current research by play theorists and ethologists has shown that play behaviour in animals is both complex and crucial in determining social patterns, and Schiller’s account may have anticipated these observations. I argue that through (...) Schiller’s theory of play and our current research on animal play, it is possible to undermine the systematic removal of the animal from the moral realm that happens in modern philosophy. Through play theory, there is a possible way to undermine the assumption that animals are incapable of achieving the status of moral agents, providing an alternate route to the standard view of animals as moral patients. La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. In his new book Emotion: The Basics, Michael S. Brady introduces the fundamentals on the philosophical approach to emotions: by fleshing out these basic tenets Brady provides insight into a core component of all our lives and covers the nature of emotions, their relationship to knowledge and understanding, and their relationship to our moral and social selves. In my comments, I value the achievements of Brady's work as well as explore a critical approach to the book in which I emphasise (...) how the book deals with the dichotomy between emotions and reasons. I also engage with the limitations that emerge from a viewpoint of a scholar specialised on the history of philosophy and epistemology, and point towards some puzzles that ought to be further considered. Building upon the insights of scholars attuned to story, narrative, and myth, this article explores the relationship between myth, science, and religion. After clarifying the interplay of the three terms—story, narrative, and myth—and the preference for the term myth, this article will argue that myth can serve as a medium through which religion, neuroscience, and mental well‐being interact. Such an exploration will cover the role of myths in religion, the neurological basis of myth, and the practices of narrative psychology and (...) bibliotherapy. The article will conclude with suggestions for understanding and utilizing the relationship between myth and the scholarly study of the relationship between science and religion. This article ultimately suggests that myth can operate as a methodological aid to the science‐and‐religion field. (shrink)

Las Tecnologías de Información y Comunicación se presentaron como una alternativa “efectiva o no”, tanto para quienes enseñan su uso como para quienes las utilizan; es un hecho, se quiera o no, que arribaron a nuestra sociedad para permanecer y multiplicarse, una realidad compleja ante la cual tenemos dos alternativas: las proporcionamos, las profundizamos. Tecnológicamente hablando, hasta el ocaso de la era paleolítica, nuestros congéneres no tenían nada que decir…, sin embargo, si podían hablar y comunicarse por medio de la (...) palabra. El lenguaje es consustancial al ser humano; es importante hacer esta aclaración. El cuerpo humano, sobre todo ambas extremidades, fueron los primeros instrumentos que empleó la humanidad como apoyo para recordar y contar. Los dedos de la mano, pueden considerarse los primeros apoyos de los que se valieron hombres y mujeres de la antigüedad para contar y constituyen, por tanto, la noción más elemental de la aritmética, anterior incluso a la noción de número. Es muy probable que los dedos de las manos y los pies hayan sido el origen de los sistemas numéricos quinario, decimal y vigesimal: es decir, el Hombre podía contar cinco, diez o veinte. Los constantes cambios tecnológicos —políticos y filosóficos— que se manifestaron en el Siglo XX dieron como resultado la aparición a lo que se ha dado en llamar “Era de las Tecnologías o Informática” que ha cambiado radicalmente la situación mundial en todos los aspectos, y que ha dado origen a una revolución tecnológica presente cada día. Este artículo revisa el proceso histórico de la ‘Conquista del desierto’ y la existencia de campos de concentración para indígenas en Argentina a través de una lectura de hermenéutica filosófica. El objetivo del artículo es interpretar el periodo y el uso de campos como instancias que configuraron la diferenciación del pueblo mapuche como sujeto racializado en la sociedad argentina. Los resultados de la exposición muestran que la marginación del cuerpo mapuche ocurre por el registro de excepciones y que aquella es (...) disputada por sujetos mapuche. This paper reviews the historical process of the ‘Conquest of the Desert’ and the existence of concentration camps for indigenous people in Argentina. The research is conducted through philosophical hermeneutics. The objective of the paper is to read the period and the use concentration camps as instances that shaped the differentiation of the Mapuche people as a racialized subject in Argentine society. The results of the argumentation show that marginalization of the Mapuche body occurs through the registration of exceptions, which is disputed by Mapuche subjects. (shrink)

The discussions of these past twenty years have significantly improved our knowledge about the foundation of bioethics and the meaning of the four bioethical principles with concern to at least three different points: that they are organised hierarchically, and therefore not “prima facie” of the same level; that they have exceptions, and consequently lack of absolute character; and that they are neither strictly deontological nor purely teleological. The only absolute principle of moral life can be the abstract and unconcrete respect (...) of human beings. But when determining the material content of this respect, principles become contingent and relative. Therefore, moral reasoning must have necessarily no less than three moments, one absolute but merely formal, namely respect for all human beings, and the other two relative and material. The first material moment is comprised of the four bioethical principles, divided into two levels, one private, including the principles of autonomy and beneficence, and the other one public, including those of nonmaleficence and justice. The second material moment deals with specific cases, and requires analysis of their context, including their circumstances and consequences. Only when following these steps, and therefore balancing principlism and contextualism, can moral reasoning be correct and complete. (shrink)

This article is a response to Josh Reeves's recent book Against Methodology in Science and Religion: Recent Debates on Rationality and Theology that welcomes Reeves's proposal for an anti‐essentialist future for the field of science‐and‐religion, particularly because it has the potential to move the field beyond current, well‐worn methods: the dominance of Christian theology and doctrine, the importance of credibility strategies, and the dependence upon philosophical discourses. Reeves’ proposal has the potential to open the science‐and‐religion field to other topics, problems, (...) and methods, such as studying lived science‐and‐religion. One way of doing this is to study popular culture and its artifacts such as literature, which portrays a co‐mingling of religion and science at the level of day‐to‐day experiences and practices of characters. For at the level of lived experience, religion and science are not well‐defined disciplines neatly compartmentalized into separate academic departments. (shrink)

During the last thirty years different methods have been proposed in order to manage and resolve ethical quandaries, specially in the clinical setting. Some of these methodologies are based on the principles of Decision-making theory. Others looked to other philosophical traditions, like Principlism, Hermeneutics, Narrativism, Casuistry, Pragmatism, etc. This paper defends the view that deliberation is the cornerstone of any adequate methodology. This is due to the fact that moral decisions must take into account not only principles and ideas, but (...) also emotions, values and beliefs. Deliberation is the process in which everyone concerned by the decision is considered a valid moral agent, obliged to give reasons for their own points of view, and to listen to the reasons of others. The goal of this process is not the reaching of a consensus but the enrichment of one's own point of view with that of the others, increasing in this way the maturity of one's own decision, in order to make it more wise or prudent. In many cases the members of a group of deliberation will differ in the final solution of the case, but the confrontation of their reasons will modify the perception of the problem of everyone. This is the profit of the process. Our moral decisions cannot be completely rational, due to the fact that they are influenced by feelings, values, beliefs, etc., but they must be reasonable, that is, wise and prudent. Deliberation is the main procedure to reach this goal. It obliges us to take others into account, respecting their different beliefs and values and prompting them to give reasons for their own points of view. This method has been traditional in Western clinical medicine all over its history, and it should be also the main procedure for clinical ethics. (shrink)

In his recent book Peirce and the Threat of Nominalism, Paul Forster presented how Peirce understood the nominalist scruple to individualise concepts for collections at the cost of denying properties of true continua. In that process Peirce showed some vibrant problems, as for example, the classic one of universals. Nonetheless that work is still incomplete; as long as that should be adequately related with what Peirce called his ‘scholastic realism’. Continuity is started by the theory of multitude and frees his (...) analysis from any constraints of the nominalist theories of reality as integrated by incognizable things-in-themselves. His theory of multitude, instead, can be derived with mathematics: By drawing in the work of the ways of abstraction in diagrammatic reasoning made by Sun Jo Shin and in continuum theories by Cathy Legg I will show the device of diagrammatic reasoning as a plausible pragmatic tool to represent those continua and make sense of his scholastic realism. The analysis of continuity is a perfect example of how the method of diagrammatic reasoning helps unblock the road of philosophical inquiry and also helps to clarify other problems as, for example, the applicability of Mathematics. General concepts define continua, and, while the properties of true continua are not reducible to properties of the individuals they comprise, they are still intelligible and necessary to ground any science of inquiry. This is a Trilingual collection of contributions made by members of the Peirce Latin-American Society to their inaugural event in 2019. it is a historical book since there is no such comprehensive approach to the variety of Peirce studies in Latin-America that shows the history of the reception of Peirce and his Pragmatism, a dialogue with the philosophy and thought of the region and, furthermore, contributions to the study of Peirce's thought made from the Americas.

The role of academic satisfaction on persistence and successful academic behavior has been the focus of research for decades. Nevertheless, driven by positive educational psychology, subjective well-being has been highlighted as another central feature in the academic path of students. Studies aimed at identifying the variables that contribute to explain different aspects of academic performance have been widely investigated, although studies aimed at identifying the determinants of subjective well-being are still limited. The present paper examined the contribution of AS judgments (...) on subjective well-being. To this end, it was hypothesized that SWB levels depend on the balance between positive/negative emotions and life satisfaction judgments. Furthermore, it was stipulated that AS has an indirect contribution on SWB, through life satisfaction, whereas the balance of emotions influences both AS judgments and life satisfaction. Using an analysis strategy based on structural equation modeling, the results indicated that the model fitted satisfactorily, explaining 32% of the variance of SWB. Particularly, it was observed that AS judgments contributed to life satisfaction judgments. Although no direct contribution of AS on SWB was reported, a total contribution partially mediated by life satisfaction judgments was revealed. These findings support the importance of academic satisfaction judgments, not only because of their importance in academic terms, but also because of their impact on university students’ subjective well-being and health. In a recent opinion paper, it was argued that individuals with multiple retractions or a record of academic misconduct should not serve as editors, including as editors-in-chief, on the editorial boards of scholarly or academic journals. As a first step towards appreciating how such a policy could be applied in practice, the presence of 30 individuals listed on the Retraction Watch Leaderboard on editorial boards was screened. Six cases are highlighted to gain an appreciation of the potential reputational risks that (...) journals and publishers might incur by including individuals with a tainted academic record on editorial boards. Given the reputational, legal and other risks associated with this type of assessment and decision, more formal positioning and guidance are needed by global ethics policy-related bodies such as COPE, the ICMJE, and the CSE, even more so in journals that claim to follow these organizations’ ethical guidelines.
